These terms govern your use of ecscashandcarry.co.uk (the "Website") and the purchase of products from ECS Cash & Carry Ltd ("we", "us", the "Company"). By using the Website or placing an order you agree to these terms.

Use of the website

You may use the Website for lawful personal or business purposes only. You must not attempt to gain unauthorised access, interfere with its operation, or use it in a way that could damage the Company or other users.

Orders and contract formation

All orders are offers to purchase and are subject to acceptance by us. An order is only accepted when we send a dispatch confirmation email. We reserve the right to decline or cancel any order, including (without limitation) where pricing errors, stock shortages or suspected fraud arise.

Pricing and payment

Prices are displayed in pounds sterling and, where appropriate, exclude VAT. VAT is added at the applicable rate at checkout. Payment is taken at the point of order. Where a trade account is in place, payment terms agreed in writing apply.

Delivery

Delivery timescales are estimates and not guaranteed. Risk in goods passes to you on delivery; title passes on full payment. Please refer to our Delivery page for current options and charges.

Returns

Our Returns Policy forms part of these terms. Statutory rights under the Consumer Rights Act 2015 are unaffected.

Age-restricted products

Tobacco products, rolling papers and certain other items are restricted to customers aged 18 or over. You confirm that you meet the legal age when ordering. We may refuse to supply where we reasonably believe the purchaser is underage.

Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot lawfully be limited. Subject to that, our total liability arising out of or in connection with any order is limited to the price paid for the products giving rise to the claim. We are not liable for indirect or consequential losses including loss of profit, business, or opportunity.

Intellectual property

All content on the Website (text, images, logos, trade marks) is owned by or licensed to the Company. You may not reproduce or redistribute content without our prior written consent.

Governing law and jurisdiction

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from or in connection with these terms.
